Welcome to All Things Niche. These Terms & Conditions govern your use of our website and the purchase of products from us. By accessing our website or placing an order, you agree to be bound by these Terms & Conditions.

Throughout these Terms & Conditions, "All Things Niche", "we", "our", and "us" refer to All Things Niche.

"Customer", "you", and "your" refer to any person accessing our website or purchasing products from us.

2. Product Information

We make every effort to ensure product descriptions, specifications, images, and pricing are accurate.

However:

  • Product colours may vary depending on screen settings and device displays.

  • Product images are for illustrative purposes only.

  • Actual size, colour, finish, and appearance may vary slightly.

  • Natural gemstones, crystals, pearls, and handcrafted products may contain unique variations and characteristics.

Such variations do not constitute defects.

All product descriptions, materials, sizes, and specifications are provided to the best of our knowledge. Customers are responsible for reviewing product information before purchase. Minor variations in colour, finish, texture, stone appearance, or handcrafted details are considered normal characteristics of jewellery and do not constitute defects.

Product Safety

Certain jewellery items may contain small parts and may present a choking hazard. Products should be kept out of reach of young children and used only as intended.

Skin Sensitivities and Allergic Reactions

Individual reactions to metals and materials can vary. Customers are responsible for reviewing product material descriptions before purchase. All Things Niche is not responsible for allergic reactions, skin sensitivities, or irritation resulting from materials used in products unless required by law.

3. Pricing

All prices displayed are in New Zealand Dollars (NZD) unless otherwise stated.

We reserve the right to change prices at any time without notice.

Prices displayed on the website at the time of purchase will apply to your order.

4. Pricing Errors

While we take reasonable care to ensure pricing is accurate, errors may occasionally occur.

If a product is listed at an incorrect price due to a typographical error, technical issue, supplier pricing change, or other mistake, we reserve the right to:

  • Cancel the order;

  • Refuse the order; or

  • Contact you to offer the product at the correct price.

If payment has already been made, a full refund will be provided.

5. Acceptance of Orders

Submission of an order does not constitute acceptance of that order.

An order is accepted only when:

  • Payment has been successfully received; and

  • The order has been processed and dispatched by us.

We reserve the right to refuse or cancel any order at our sole discretion.

6. Product Availability

All products are subject to availability.

We reserve the right to:

  • Limit quantities;

  • Discontinue products;

  • Cancel orders where stock is unavailable; and

  • Substitute packaging where necessary.

If stock is unavailable after purchase, we will provide a refund or alternative solution.

7. Custom and Personalised Products

Custom-made, personalised, engraved, altered, or special-order items cannot be cancelled, returned, exchanged, or refunded unless required by applicable law.

Once production has commenced, changes may not be possible.

8. Payment

Payment must be received in full before goods are dispatched.

We reserve the right to withhold shipment until payment has been successfully verified.

9. Shipping and Delivery

Delivery timeframes are estimates only and are not guaranteed.

We are not responsible for delays caused by:

  • Couriers;

  • Postal services;

  • Customs processing;

  • Weather events;

  • Industrial action;

  • Natural disasters; or

  • Circumstances beyond our reasonable control.

Risk in the goods passes to the customer upon delivery to the address supplied during checkout.

Customers are responsible for ensuring delivery details are correct.

Additional shipping charges may apply if parcels are returned due to incorrect information supplied by the customer.

10. Lost or Missing Parcels

If a parcel is lost in transit, we will assist with lodging enquiries with the courier.

Where courier tracking confirms delivery to the address supplied by the customer, responsibility for the parcel transfers to the customer unless otherwise required by law.

11. Returns and Refunds

Returns, exchanges, and refunds are governed by our Returns & Refunds Policy.

Customers should review that policy before placing an order.

12. Care of Jewellery

Customers are responsible for properly caring for purchased jewellery.

Jewellery should be removed before:

  • Swimming;

  • Showering;

  • Exercising;

  • Cleaning;

  • Applying perfumes or cosmetics; and

  • Activities likely to cause damage.

Failure to follow care recommendations may affect product longevity and is not considered a manufacturing fault.

13. Warranty and Consumer Guarantees

Nothing in these Terms excludes rights available under the Consumer Guarantees Act 1993 or other applicable New Zealand legislation.

Subject to those rights, our liability is limited to repair, replacement, or refund at our discretion.

All Things Niche reserves the right to investigate claims relating to lost parcels, damaged goods, missing items, chargebacks, and refund requests. Where fraudulent, misleading, or dishonest claims are suspected, we reserve the right to refuse refunds, replacements, exchanges, or future orders and may provide relevant information to payment providers, couriers, insurers, or authorities where appropriate.

14. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, special, consequential, or economic loss.

  • We are not liable for loss of profits, loss of opportunity, loss of business, or loss of data.

  • Our total liability arising from any claim shall not exceed the purchase price paid for the relevant product.

You agree not to:

  • Use the website for unlawful purposes;

  • Attempt to interfere with website functionality;

  • Upload malicious software;

  • Copy, reproduce, distribute, or exploit website content without permission.

We reserve the right to restrict or terminate access to users who breach these Terms.

By submitting reviews, photographs, comments, testimonials, or other content, you grant All Things Niche a non-exclusive, royalty-free, perpetual licence to use, reproduce, publish, and display such content for marketing and business purposes.

We are not responsible for failure or delay in performing obligations where such failure results from events beyond our reasonable control including:

  • Transport disruptions; or

21. Governing Law

These Terms & Conditions are governed by the laws of New Zealand.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.

We reserve the right to amend these Terms & Conditions at any time.

Updated versions will be published on our website and become effective immediately upon publication.
